General Contractual Terms and Conditions of Sale
The website www.agricolamonaci.com is owned and operated by FRANCESCO MONACI, owner of AZIENDA AGRICOLA MONACI FRANCESCO, with registered office at Piazzale Europa 1/C, 58033 Castel del Piano (GR), VAT No. 01579930536 – Tax Code MNCFNC83S11E202I – email: info@agricolamonaci.com.
By accessing the website www.agricolamonaci.com, the consumer agrees to comply with the terms and conditions set out below, including all documents referred to herein. Users are invited to read this document carefully before using the services.
Article 1 – Subject Matter of This Agreement
This agreement concerns the sale and purchase of bottled and tinned olive oil, chestnuts and chestnut-based products, including flour and confectionery, own-produced honey in jars, and other own-produced food products, including vegetables, in the quantities and of the quality selected by the consumer through the choice of products on the website www.agricolamonaci.com.
The goods and services offered for sale are those described on the pages of www.agricolamonaci.com. The information provided may be amended and periodically updated, including for the purpose of further improving the service offered to consumers.
Product images displayed on the website may vary and must therefore be regarded as purely illustrative and non-binding.
Article 2 – Prices and Product Availability
The prices of the products referred to in Article 1 are shown on the website and include VAT.
Where applicable, shipping costs must be added to the product price. Their amount is always shown on the website and varies according to the delivery method requested, in addition to any customs duties.
If a product is unavailable, the consumer will be promptly informed by email.
The prices and availability of products sold through www.agricolamonaci.com may be changed without prior notice.
Article 3 – Purchase Agreements Entered into by Minors
In the event of a purchase by a person under the age of eighteen who has provided false information regarding their age or false details in order to purchase the goods and/or access the data available on the website, the parents shall in any event be directly responsible for payment of the items purchased by their children under the age of eighteen, without prejudice to the rules on withdrawal set out in Article 6 of these Terms and Conditions of Sale.
Article 4 – Orders and Invoicing
Orders are accepted in writing, by email, online or by telephone.
The conclusion of the agreement is subject to receipt of the order by www.agricolamonaci.com.
The invoice will be issued after delivery of the goods, within the time limits prescribed by law. Unless otherwise requested by the consumer, the invoice will be sent by email.
Article 5 – Delivery of the Goods
The goods will be delivered to the address provided by the consumer through the courier appointed by www.agricolamonaci.com.
The delivery times shown on the website are indicative and are expressed in working days. If delivery takes longer, the customer may not claim any right on that basis, without prejudice to the fact that delivery will take place within 30 days starting from the day after the order is sent.
In order to prevent fraud, the courier reserves the right to inspect an identity document proving that the order details match those of the credit card holder.
For the purpose of ensuring more efficient delivery of the goods, www.agricolamonaci.com will provide the courier with the telephone number supplied by the consumer when registering on www.agricolamonaci.com or when placing the order.
This telephone number will be used in compliance with the privacy legislation referred to in Italian Legislative Decree No. 196/2003.
The courier will make one delivery attempt only, unless otherwise specified when the order is placed.
If delivery with prior telephone notice has been requested, the courier will contact the recipient at the telephone number provided before attempting delivery, in order to agree on a delivery day and a time slot of at least three hours.
If the recipient does not answer the first call, the courier will attempt to contact them again on the following working day.
If the courier is unable to contact the recipient after two telephone attempts, the consignment will be placed in storage as “customer not contactable”.
The customer will then be required to pay EUR 15.00, including VAT, in order to release the consignment from storage and arrange redelivery.
The recipient will likewise be required to pay EUR 15.00, including VAT, if the goods are placed in storage because neither the recipient nor a person authorised to collect them is present, despite prior delivery arrangements having been made with the courier.
If the customer fails to release the consignment within five working days after it has been placed in storage, the goods will be returned to Azienda Agricola Monaci Francesco and the amount paid will be retained as reimbursement.
The customer may nevertheless request redelivery of the goods no later than 15 days after the consignment was placed in storage, subject to payment of the storage costs, the costs of returning the goods to the warehouse and the redelivery costs, which will be calculated on a case-by-case basis.
DELIVERIES TO UPPER FLOORS OR CELLARS ARE NOT PROVIDED.
Delivery to an upper floor or cellar is a paid service and must be requested before payment of the order.
At the time of receipt or collection of the goods, the consumer or the person authorised to collect them must verify, in the presence of the person making the delivery, that the goods are intact and correspond to the order placed.
If the packaging appears damaged, the consumer must ACCEPT the parcel subject to a specific reservation, describing the damage found, and must record the damage on the consignment note or transport document.
If one or more products are damaged or do not correspond to the order placed, the consumer may submit a claim only if the damage was previously recorded on the consignment note or transport document.
Within three working days of delivery, the consumer must notify www.agricolamonaci.com by email at info@agricolamonaci.com and provide supporting evidence, including photographs, of the damage or incorrect supply.
The burden of proof lies with the consumer.
www.agricolamonaci.com reserves the right to request the return of damaged or incorrectly supplied goods at the consumer’s expense.
The goods must be returned within 15 days of the request by www.agricolamonaci.com, failing which the right to replacement or reimbursement will be lost.
Once www.agricolamonaci.com has verified the damage or incorrect supply, it will, at its own expense and no later than 30 days from the date of delivery or notification, replace the damaged or incorrect products or, if replacement is not possible, refund the corresponding amount to the consumer.
If the customer contacts Customer Service after the third working day, Azienda Agricola Monaci Francesco may decide, at its discretion, whether to open a case for the possible replacement of the damaged or incorrect goods.
Article 6 – Right of Withdrawal
The consumer may exercise the right of withdrawal no later than 14 working days from the date on which the goods are received.
This right must be exercised by sending a registered letter with return receipt to:

The notice may also be sent in advance, within the same period, by email to info@agricolamonaci.com, provided that it is confirmed by registered letter with return receipt within the following forty-eight hours.
The goods must be returned to Azienda Agricola Monaci Francesco at the consumer’s expense, intact, unchanged and complete with their original packaging, no later than 15 days after notice of withdrawal is given.
Azienda Agricola Monaci Francesco will refund the amounts paid within a maximum of 30 days from the date on which the registered letter is received and, in any event, not before receiving the goods and inspecting the condition of the items subject to withdrawal.
The costs and risks associated with returning the products will be borne by the consumer.
European Union legislation provides that the right of withdrawal may be exercised only by natural persons, namely consumers, acting for purposes unrelated to their trade or business.
The right of withdrawal therefore CANNOT be exercised by legal persons or by natural persons acting for purposes connected with a commercial activity.
Purchases made by resellers or by persons who purchase products for resale to third parties for any reason are also excluded from the right of withdrawal.
The right of withdrawal does not apply to the supply of goods made to measure or clearly personalised, or goods which, by their nature, cannot be returned or are liable to deteriorate or expire rapidly.
In the case of promotional transactions in which the purchase of one item is combined with another item sold at a nominal price or supplied free of charge, the right of withdrawal may be validly exercised only by returning both items included in the purchase, given that the promotional item is ancillary to the first item.
Article 7 – Limitation of Liability
Azienda Agricola Monaci Francesco accepts no liability for any damage arising from the use or misuse of the service provided through www.agricolamonaci.com.
Azienda Agricola Monaci Francesco accepts no liability for errors or omissions on www.agricolamonaci.com or on any website referred to or linked from it.
Azienda Agricola Monaci Francesco reserves the right to update www.agricolamonaci.com continuously and at any time.
The information may contain inaccuracies of any kind or typographical errors.

Azienda Agricola Monaci Francesco accepts no liability for service failures attributable to unforeseeable circumstances or force majeure, including accidents, explosions, fires, strikes and/or lockouts, earthquakes, floods and other similar events that prevent the agreement from being performed, in whole or in part, within the agreed time limits.
Azienda Agricola Monaci Francesco will not be liable for damage, losses or costs incurred as a result of non-performance of the agreement for the reasons set out above.
The consumer may, where applicable, be entitled only to reimbursement of the price paid.
Except in cases of wilful misconduct or gross negligence, any compensation payable by Azienda Agricola Monaci Francesco may not exceed the price of the products purchased by the consumer in relation to which the dispute arose.
Article 8 – User and Consumer Liability
The user must ensure that the data entered are truthful, complete and up to date, and must promptly communicate any changes.
If false statements are made, Azienda Agricola Monaci Francesco reserves the right to remove the persons concerned from its user lists after a formal request for self-correction has been issued and not accepted.
Article 9 – Copyright and Trade Marks
